Terms and Conditions
The use of SipNack.com services is subject to the following terms and
conditions. By using services provided by SipNack.com you are hereby
agreeing to the following.
1. Violation of Terms and Conditions: If a user is found to be in
violation of the terms of service, the users SipNack.com account will be
deactivated and any IP's associated with the user's account will be
blocked from accessing any portion of SipNack.com or its corresponding
services. Sipnack.com reserves the right to take any other appropriate
steps to prevent the removed user from gaining access to the SipNack.com
services. Any moneys owed to the user at the time the user is found to
be in violation of the terms of service will be forfeited, SipNack.com
shall be the sole arbitrator of this, and the user shall have no other
legal recourse.
2. Fraudulent and Malicious Activity: Users may not place any call(s)
through the Sipnack.com service without the intent of communicating with
another party. Users found to be doing so will be removed from the
service and reported to the proper party who may wish to press charges
against the user, as placing a call without intent to communicate is
illegal in the United States Of America. Any user whom SipNack.com
believes to be involved with placing any fraudulent or malicious calls,
or involved in any fraudulent or malicious activity via or in connection
to SipNack.com services will have their account deactivated immediately,
without notice. Users may be reactivated if the user is able to offer a
valid explanation for the activity in question, however reactivation is
at the sole discretion of SipNack.com. Users accounts which are not
reactivated within 20 days after being deactivated, will be considered
to have been in violation of the terms and conditions of SipNack.com
service.
3. Rates: Rates posted on www.SipNack.com are subject to change
without notice. All rate changes will be proactive and not retroactive,
meaning the rate change will effect all future calls but will not effect
any moneys already earned by the user.
4. Payment: Payments will be dispersed to the user 90 days after the
first day of the month which they started utilizing Sipnack.com
services. Users must earn a minimum of $100 in a given month in order to
receive payment, any monthly total of $99.99 or less will be forfeited
and will not be carried over to the following month. Payment is subject
many factors outside of SipNack.com's control, and for this reason
SipNack.com can't guarantee payment to users. SipNack.com will pay out
to a user, only if it receives payment for calls which the user placed
through SipNack.com's services. However, if SipNack.com doesn't get paid
on calls placed by a user, SipNack.com can't pay the user. If
Sipnack.com receives a payment for a users calls which covers only a
portion of what was owed, then the said user will receive a payment
which corresponds with the portion of the payment received. When the
remaining portion is received, the user will receive the remaining
portion of their moneys owed. Payments will be sent in the form of US
funds drawn from a bank located in the United States of America.
5. Local, State, and Federal Laws: Users found to be in violation of
any Local, State, or Federal law in connection with the utilization of
SipNack.com's service will be immediately removed from the service and
the users will forfeit any money's owed to them by SipNack.com, and the
user shall have no legal recourse to reclaim it.
6. Service Availability: SipNack.com reserves the right to discontinue
this service at any point to any and all users, and shall not be liable
to any user in any way, beyond SipNack.com owing the user payment for
previous calls which SipNack.com collected or collects moneys on, this
shall be subject to the terms set for in Section 4 of this document
entitled Payment.
7. Warranty: SipNack.com will use reasonable efforts to maintain the
availability of the service to users at all times, however users should
note that SipNack.com has no control over the uptime of any given
Internet Service Provider you may be using to connect with the
SipNack.com services. SipNack.com makes no warranty regarding it's
services including any Warranty of Merchantability or Fitness for a
Particular Purpose.
8. Limitations of Liability: IN NO EVENT SHALL SIPNACK.COM OR IT'S
PARENT COMPANY BE LIABLE TO USER FOR ANY SPECIAL, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION,
DAMAGES FOR LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF CUSTOMERS,
CLIENTS OR GOODWILL ARISING IN ANY MANNER FROM THIS AGREEMENT AND/OR ANY
PERFORMANCE OR NONPERFORMANCE HEREUNDER. THE USER's SOLE REMEDY FOR ANY
CLAIM AGAINST SIPNACK.COM OR IT'S PARENT COMPANY, WHETHER SOUNDING IN
TORT, CONTRACT, WARRANTY, OR OTHERWISE, SHALL BE TO TERMINATE THEIR USE
OF THE SERVICE PROVIDED BY SIPNACK.COM. IN NO EVENT SHALL SIPNACK.COM OR
IT's PARENT COMPANY BE LIABLE TO A USER FOR MONEY DAMAGES.
9. Modifications to this Agreement: SipNack.com reserves the right to
make modifications to this agreement at any time. Any modification made
to this agreement will not take effect until 30 days after such
modifications are made and are updated on the SipNack.com website. It
shall be the user's responsibility to know the current language of this
agreement, and SipNack.com is not required to provide notification to
user's of any changes made to this agreement, by may, at its discretion,
chose to do so.
